Lawsuit Update - Market Advantage Consulting
The trial against Market Advantage Consulting was held on February 25, 2003 and the Court rendered their verdict on March 4, 2003 Internet Business Initiatives, LLC.
The case was the first court test of the Kansas Commercial Electronic Mail Act.
The claim requested a fine of $500 each for two violations of the Law in one email message. The first violation was for failure to place ADV: in the subject line since it was an unsolicited commercial email. The second violation was for a failure to include the corporate address and/or an 800 phone number.
The defendant put up a credible defense that they had implemented best practices subscription management in accordance with the law, even though their procedures were in place after the infraction. The Court allowed them one exception under the law and awarded the plaintiff (us) $500.00 plus court costs of $51.00
The judgment was presented to the defendant and within the week they paid.
