Lawsuit Update - Data Resource Consulting

Data Resource Consulting lost their case in Kansas Small Claims Court on September 9, 2003. They were fournd guilty of 52 violations of KS 50-6,107 the commercial electronic mail act.

Prior to the filing they spammed us 3 times. Even after they were served they spammed us 10 more times. Each message had 4 violations of the Act.

The violations were:

  1. Failure to place ADV: in the subject line
  2. No company address or 800 phone number
  3. A non-working unsubscribe link
  4. Obscuring the point of origin or transmission path

What is very intriguing about this Spam message is they offer to construct a message and send out 1.8 million emails on our behalf for $1,500.00

Also they reference a Federal 'law' that isn't and even it was, it doesn't apply to electronic mail communications. This is a standard ploy of spammers to confuse the uninitiated.

"Under Bill S. 1618 Title III, passed by the 105th U.S. Congress, this letter cannot be considerd spam as long as the sender includes contact information and a method of removal."

Note: They couldn't even spell the word 'considered' correctly in their disclaimer!
